By accessing and using YesBOT — A product by YESMonetize ("Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, you should not use the Service.

2. Description of Service

YesBOT is a Facebook Messenger automation and broadcasting platform that provides:

• Automated messaging through Facebook Messenger
• Broadcast messaging to page subscribers
• Comment automation and auto-replies
• Subscriber management and segmentation
• Campaign scheduling and management
• Analytics and reporting

3. User Obligations

By using our Service, you agree to:

• Comply with all applicable laws and regulations
• Comply with Facebook's Platform Policies, Terms of Service, and Community Standards
• Not send spam or unsolicited messages to users who have not opted in
• Not use the Service for any illegal or unauthorized purpose
• Not distribute malware, viruses, or any harmful code through the Service
• Maintain the confidentiality of your account credentials
• Not collect or harvest user data without proper consent
• Respect the privacy of Facebook users and subscribers

4. Facebook Compliance

You acknowledge that the Service operates through the Facebook Platform and that your use is subject to Facebook's policies. You are responsible for ensuring that your messages and automated content comply with:

• Facebook Messenger Platform Policy
• Facebook Community Standards
• Facebook Advertising Policies (where applicable)
• Message tag usage requirements (24-hour window rule)

We reserve the right to suspend or terminate your access if we detect violations of Facebook's policies that may affect the Service or other users.

5. Account Registration

To use the Service, you must create an account and provide accurate and complete information. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of YESMonetize Network. You retain ownership of any content you create and send through the Service.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

We are not responsible for any actions taken by Facebook that may affect the functionality of the Service, including but not limited to API changes, rate limiting, or account restrictions.

8. Message Delivery

While we strive to deliver all messages successfully, we cannot guarantee delivery of messages due to factors beyond our control, including Facebook API limitations, recipient blocking, or network issues. Message delivery rates and success depend on Facebook's platform availability and policies.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.
